Terms & Conditions

A. GENERAL

A1. ID Proof  

All passengers, excluding infant/accompanied minor, must carry along & present a valid photo identification (in original) when asked by Air Taxi staff/security staff at airport. The photo identification document must be carried in original & should be in a good & readable condition. Following is a list of acceptable photo identification documents:

  1. Passport
  2. Voter ID card
  3. Aadhaar/m-Aadhaar
  4. PAN Card
  5. Driving License
  6. Service Photo ID Card issued by state/central government, public sector undertakings, local bodies or public limited companies
  7. Student Photo ID Cards issued by government Institutions/government recognized educational institutions
  8. Nationalized Bank Passbook with attested photograph
  9. Pension card/Pension documents having photograph of the passenger.

Aadhar/PAN card/Driving Licence shown through the Digilocker account shall be considered valid, only when the passenger logs into his/her DigiLocker account & shows the ID proof from the ‘Issued Documents’ section. ID proof from the ‘Uploaded Documents’ shall not be considered.

In case of infant/accompanied minor, accompanied by their parents/guardian who is a bonafide passenger on the same reservation, must carry & present a valid ID proof as listed above, when asked by Air Taxi Staff/Security Staff at the Airport. Unaccompanied Minor must carry & present a valid ID Proof as listed above, when asked by Air Taxi Staff/Security Staff at the Airport. In case of infant or minor, please carry a valid birth certificate.

In case of a passenger, who for some valid reasons is not in a position to produce any of the above listed photo ID proofs, an Identity Certificate issued by a Group ‘A’ Gazetted Officer of the Central/State Government on his official letterhead with passengers photograph duly attested along with the passengers name, will be valid for this purpose.

Passenger must ensure that the name entered while booking matches with the ID proof carried along on the day of travel. Name change is not permitted on your booking. At the time of booking a ticket, in case you do not have Last Name (as per your Photo ID proof), enter your First Name in the Last Name box again.

All NRI’s or foreigner must carry & present a valid passport when asked by Air Taxi Staff/Security Staff at the Airport.

Valid Passport for NRI’s should be understood as & inclusive of a valid Overseas Citizen of India (OCI)/Person of Indian Origin (PIO) card.

Valid Passport for foreigners should be understood as & inclusive of a valid VISA/e-VISA/Permit to stay/travel in India.

 

A2. ‘Fit To Fly’ Medical Certificate

All passengers, having one of the below mentioned health condition(s), or some other abnormal medical condition not covered below, must carry a valid 'Fit To Fly’ medical certificate issued by his/her treating/consulting doctor. The certificate must have date of issue, date of travel, medical details, doctor’s name, signature, registration number & contact details.

Some health/medical conditions requiring 'Fit To Fly’ medical certificate are as follows (is indicative & not exhaustive):

  1. Any condition/complication/illness that may cause health problems during flight/travel
  2. Any condition/complication/illness that may cause death during flight/travel
  3. Any contagious/infectitious/viral illness
  4. Undergone critical operation/surgery in the past 30 days
  5. Expectant mothers (from the beginning of 28th week till the end of 36th week of pregnancy)
  6. Discharged after a hospitalization of more than a week
  7. Any passenger doubtful about his health/medical condition.

Air Taxi advices in the best interest & convenience of the passenger & fellow passengers, in case someone is unsure whether he/she requires a medical certificate, to always obtain a ‘Fit To Fly’ medical certificate & produce it when asked about existing/past health condition by the Air Taxi staff during the travel.

 

A3. Check-In/Web Check-In

As per the government directives, it is now mandatory for all passengers to do web check-in for all flights. Passenger will only be permitted to enter the airport after showing a boarding pass print out or a mobile/digital boarding pass generated from Air Taxi website www.flyairtaxi.in/mobile app.

Air Taxi web check-in starts 48 hours prior & closes 1 hour prior to the scheduled departure time. 

Air Taxi check-in closes 30 minutes before the scheduled departure time.

For passengers who need assistance with check-in or reissuance of boarding pass at the airport, should report at the departure airport at least 1 hour prior to the scheduled departure time. For such passengers, a facilitation charge per passenger will be charged as given in ‘Fares, Taxes, Fees & Charges’ section.

For web check-in, please do the following steps:

  1. Log on to the website www.flyairtaxi.in
  2. Click on ‘Web Check-In’
  3. Now enter your PNR Number & last name/email (same as what you entered while booking)
  4. Confirm all details are correct
  5. If needed, buy extra baggage
  6. Next, click on ‘Continue Check-In’. The system will now generate your boarding pass
  7. Do not forget to take a print or digital copy of your boarding pass on the day of travel.

 

A4. Gate No Show

After web check-in & printing your boarding pass, please ensure that you go through the security check at the airport well before time & await the boarding call. In any case, failure to show up at the boarding gate 15 minutes prior to the scheduled departure of the flight would result in the passenger being declared as ‘Gate No Show’.

Air Taxi is not responsible for your not boarding the flight once the departure is announced. In case of ‘Gate No Show’, refund will be processed as per ‘Gate No Show’ refund rule given in ‘Fares, Taxes, Fees & Charges’ section.  

 

B. BAGGAGE RULES

B1. Please read the baggage rules carefully before packing for the trip. Strict compliance w.r.t. the list of prohibited items as prescribed in BCAS regulations is mandatory, as ‘Dangerous Goods’ are prohibited to be carried on board.

Dangerous Goods: Articles or substances which are capable of posing a hazard to health, safety, property or the environment.

B2. Air Taxi allows cabin (hand) baggage only. There is no provision for check-in baggage on Air Taxi aircrafts.

B3. Passengers will be subjected to a security screening prior to boarding the aircraft, which is mandatory as per Indian Regulations. As per Government of India security regulations, Passengers will be required to undergo personal frisking & their hand baggage has to undergo X-ray/physical checking before boarding. Unidentified baggage will not be loaded into the aircraft. A secondary security check may also be carried out near the step ladder/boarding gate before embarkation as & when stipulated by BCAS/Air Taxi Staff.

B4. Each passenger may bring one piece of baggage, typically not exceeding ‘25 cm x 55 cm x 35 cm’ in dimension & 7 kg in weight. Infants do not qualify for a free baggage allowance. Additionally, paid services can be utilised for extra baggage, as per the rate given in ‘Fares, Taxes, Fees & Charges’ section.

B5. Along with one piece of cabin (hand) baggage, you may also be permitted to carry one of the following personal items, subject to weight limitation & security clearance:

  1. 1 lady's hand bag or
  2. 1 laptop bag or
  3. 1 duty free shopping bag (untampered).

B6. Passenger(s) carrying more than the allowable free baggage, will be charged for the extra baggage at the airport, as per the rate given in the Fares, Fees & Charges section.

B7. Prepaid extra baggage once purchased, cannot be cancelled. Prepaid extra baggage cannot be used partially (e.g. if a passenger has bought 3 kg & extra baggage is just 2 kg then the remaining 1 kg is non-transferable/non-refundable/non-reusable).

B8. Liquid, Aerosol & Gaseous items such as drinks, cream, perfume, spray, gel or toothpaste must be in containers of 100 ml/3.4 oz (by volume) or 100 g (by weight) or less. Those carried in containers larger than 100 ml will not be accepted, even if the container is only partially filled.

B9. Duty free purchases such as liquor, cigarette & perfume are permitted in reasonable quantities only. However, liquid restrictions in effect at many airports may prevent these items from getting past security screening points. Duty free items will be considered part of cabin (hand) baggage, any exceedance to the baggage limitation will be charged as extra baggage.

B10. Cabin (hand) baggage cannot be accepted if it:

  1. Is unsuitable for air carriage due to its weight, size or nature
  2. Has any sharp or weapon-like objects or items that look like weapons (i.e. replica/imitation), sporting goods, metal cutleries, disabling device, compressed gases, corrosives, radioactive material, magnetized material, dry/wet cell batteries, apparatus containing mercury, any flammable liquid or solid such as lighter, match-sticks, fuel, copra (dry coconut) etc
  3. Has poison, infectious substance, offensive or irritating material, oxidizing material such as bleaching powder & peroxides
  4. Has any petrol/battery-operated equipment & tool.

B11. Smart baggage is allowed provided it meets the following requirements:

  1. If the batteries are non-removable, they must not exceed 0.3 g for lithium metal & 2.7 Wh for lithium ion. If smart baggage with lithium battery exceeds the above limit, then it is forbidden
  2. If its batteries are removable, they must be removed & carried separately
  3. Wi-Fi/Bluetooth/GPS must be switched off
  4. A maximum of 2 spare batteries is allowed.

B12. APPLE MacBook Pro 15-inches laptop purchased between Sep 2015 - Feb 2017, SAMSUNG Galaxy Note 7 or any locally made power bank is not allowed.

B13. Kirpan may be carried only by a sikh passenger, on his/her person, provided the length of its blade does not exceed 15.24 cm (6 in) & the total length of a kirpan does not exceed 22.86 cm (9 in).

B14. Dry ice is allowed in quantity less than 2.5 kg per person with proper packaging & space for release of vapours. The packaging should have clear marking as “DRY ICE”.

B15. Foldable/pockit baby strollers with dimensions more than ‘25 cm x 55 cm x 35 cm’ are not allowed.

B16. Wheelchair/mobility aid is not allowed on board.

B17. Airwheel/solowheel/hoverboard segway powered by lithium batteries are prohibited.

B18. Air Taxi, at its discretion, reserves the rights to refuse the carriage of passenger’s baggage or certain content of the baggage. The reason of refusal may be one of the following but not limited to:

  1. The baggage is oversized or overweight than the specified limits
  2. The baggage is not properly packed to carry in the aircraft
  3. The baggage contains security restricted article or any dangerous goods
  4. The carriage of the baggage or the content of baggage may endanger or affect the safety, health or materially affect the comfort of other passengers or crew
  5. The baggage has not gone through security check
  6. The applicable charges have not been paid for the baggage
  7. The baggage or the content of baggage has been restricted by any Government Official/Airport authority for any reason.

B19. Air Taxi will not be liable for any damage arising from Air Taxi’s compliance with applicable laws or Government rules & regulations or from the passenger’s failure to comply with the same or in cases when an item is removed/not allowed on-board by airport security (ASG/APSU)/Air Taxi security staff.

 

C. SPECIAL ASSISTANCE

C1. Unaccompanied Minor (UNMR)

Unaccompanied Minor (UNMR): Child above 5 & below 12 years of age on the date of travel & who is not accompanied by a parent/guardian/companion on the same reservation.

Air Taxi accepts unaccompanied minor (child above 5 & below 12 years of age) passengers, subject to the following conditions:

  1. Upon signing of indemnity form i.e. UNMR Request for Carriage Form by a parent/guardian of the minor
  2. Payment of an additional charge per sector per UNMR as given in ‘Fares, Taxes, Fees & Charges’ section
  3. Valid photo ID of both, the unaccompanied minor & the parent/guardian is confirmed before departure.

The UMNR ticket is issued as an ADULT. Air Taxi staff member will assist the UNMR till the boarding & upon landing till received by the authorized representative, only after ascertaining the identity of the person as per the details mentioned in the UNMR Request for Carriage Form.

Parent/guardian must remain present at the departure station until the flight has departed. The authorized representative/parent/guardian must be available at the arrival station 30 min. before the scheduled time of arrival of the flight.

Air Taxi does not carry unaccompanied minor below the age of 5 yrs. Unaccompanied minor below the age of 5 yrs must be accompanied on the same reservation by a companion aged 18 years or above.

 

C2. Infants

Infant: Child above 7 days & below 2 years on the date of travel & who is accompanied by a parent/guardian/companion on the same reservation.   

Passenger accompanying the infant must carry his/her & Infant’s valid ID for inspection (of age & ID) at the airport on the day of travel.

For safety reasons, we do not allow infants to sit on their own, they must be seated in an adult's lap.

No extra seats may be booked for infants.

Owing to limited inventory for accommodating infants per flight, only 1 infant is allowed per adult.

Infants do not qualify for a free baggage allowance. Baby seats or push chairs are not allowed on-board.

A valid birth certificate of the infant is a must for identity verification before boarding.

If the infant reaches/crosses the age of 2 years, on the day of the journey/return journey, & does not possess an adult ticket, then he/she will only be allowed to travel on that flight, subject to availability of seat & upon payment of the applicable differential adult fare, tax, fees & charges before commencement of that part of the journey.

 

C3. Expectant Mothers

Expectant mothers, till the end of 36th week of pregnancy are permitted to fly provided there are no prior complications. Expectant mothers, after the end of 36th week of pregnancy is not permitted to fly. 

However, expectant mothers from the beginning of 28th week till the end of 36th week of pregnancy will be required to carry a valid ‘Fit To Fly’ medical certificate issued by her treating gynaecologist/obstetrician, not earlier than 3 days prior to the date of travel. The medical certificate must be acceptable to the Air Taxi staff. A copy of the certificate will be retained by Air Taxi.

In case of any doubt/clarification regarding the wellbeing of the expectant mother, the company doctor may be contacted for necessary advice.

Air Taxi, shall, in no way be responsible in the event a false ‘Fit To Fly’ medical certificate is produced by the passenger & by relying upon such a certificate, Air Taxi permits the passenger to fly & any harm is caused to such passenger due to flying in such medical conditions.

Post Delivery:

Mother & infant can fly after 7 days post delivery, provided it was a normal delivery.

For a caesarean/complicated delivery, the mother will be required to carry a ‘Fit To Fly’ medical certificate issued from her treating gynaecologist/obstetrician.

 

C4. Carriage of Pets/Service Animals

Carriage of pets/service animals is not allowed on Air Taxi flights.

 

C5. Differently Abled Passengers/PRM/Passengers with Adverse Medical Condition

Air Taxi, unfortunately, does not accept passengers with reduced mobility (PRM), differently abled passengers & passengers with adverse medical condition as it neither has provision of cabin crew nor safety assistant on board. Hence, Air Taxi is not in a position to provide special assistance & service to PRM, differently abled passengers & passengers with adverse medical condition, a list of which (is indicative & not exhaustive) is as follows:

  1. Passengers having mobility problems due limbs in plaster casts/broken limbs/braces/other prosthetic devices
  2. Passengers using wheelchairs/crutches/stretchers
  3. Passengers with visual &/or hearing impairment
  4. Passengers with psychiatric or emotional disorders
  5. Passengers having intellectual disability/autism/alzheimer's/dementia/down syndrome/epilepsy
  6. Passengers travelling with internal devices such as a pacemaker or a defibrillator
  7. Passengers dependent on or carrying Portable Oxygen Concentrators (POC)
  8. Passengers with any other adverse medical condition for which they are dependent on someone else to help them overcome it.

 

D. CONDUCT ON-BOARD

D1. General Conduct

No passengers on-board shall in any manner interfere with the duties of crew or lessen their ability. Passenger shall follow all the guidelines & instructions issued by Pilot-In-Command/Air Taxi staff for ensuring their safety, other passenger’s safety, aircraft’s safety or for the purpose of maintaining good order & discipline.

No passengers shall involve into physical or verbal argument with crew or fellow passengers. They shall not intentionally involve into any act which is likely to endanger the safety of the aircraft or of any person on-board the aircraft.

If, in Air Taxi staff’s reasonable opinion, a passenger’s conduct is unacceptable, then, Air Taxi staff may take necessary measures to prevent continuation of such conduct, including restraint. In such cases, Air Taxi reserves the right to:

  1. Disembark & refuse onward carriage at any point
  2. Prosecute for offences committed on-board the aircraft
  3. Recover any & all the costs whether direct/consequential, incurred as a result of the passenger’s behaviour, including but not limited to ATC charges, diversion fuel costs, airport landing charges, necessary operational costs, costs incurred due to disrupted operations/flight delays & misconnections & inconvenience to other passengers.

 

D2. Denied Boarding/Right to Refuse Carriage

Air Taxi, may refuse to carry the passenger or their baggage, at its discretion, if one or more of the following have occurred or Air Taxi staff reasonably believes may occur:

  1. Passenger has failed to arrive at the boarding gate 15 minutes prior to the scheduled departure time
  2. Passenger has failed to check-in 30 minutes prior to the scheduled departure time
  3. The carriage of the passenger or their baggage may endanger or affect the safety, health, or materially affect the comfort of other passengers or crew
  4. Passenger has refused to submit to a security check
  5. Passenger fails to observe Air Taxi staff’s instructions with respect to safety or security
  6. Passenger’s mental or physical state, including their impairment from alcohol or drugs, presents a hazard or risk to themselves, to fellow passengers, to crew or to Air Taxi property
  7. Passenger has refused or failed to undergo health screening or a health examination requested by Air Taxi staff or by a government enforcement agency
  8. Passenger has not paid the applicable fare, tax, fees & charges
  9. Passenger does not appear to have valid travel documents
  10. Passenger presents a ticket/voucher/boarding pass that has been acquired unlawfully, altered in any way or is a counterfeit
  11. Passenger cannot prove that he/she is the person named in the ticket/voucher/boarding pass
  12. Passenger has previously committed any one of the acts or omissions referred to above, & Air Taxi has reason to believe that he/she may do so again.

 

D3. Self-offloading

Self-offloading after boarding the aircraft is not permitted, since it can cause safety & security risks, besides inconveniencing fellow passengers on board. Accordingly, in the event that any passenger expresses his/her desire to offload himself/herself & is subsequently offloaded, then he/she will have to wait in the airport premises under the observation of Air Taxi’s security staff for security reasons. Air Taxi shall cancel the entire ticket & shall not provide any refund for the same. Additionally, such passenger will have to pay a ‘self-offloading penalty’ charge as mentioned in ‘Fares, Taxes, Fees & Charges' section. Air Taxi may at its sole discretion, not penalize such passenger, in case of a medical emergency or any unforeseen mishap such as death/accident of a blood relative. However, the passenger will have to provide evidence, to justify the emergency/mishap. In case of medical conditions, Air Taxi may insist for a medical certificate from a doctor at the Airport.

 

D4. Alcohol/Drugs/Smoking

Consuming alcohol/drug abuse/smoking is strictly prohibited on all Air Taxi flights. No passenger shall consume alcohol/drugs/any psychoactive substance in any part of an aircraft during any phase of the flight.

Air Taxi reserves the right to refuse carriage of passengers in possession of E-cigarettes & of any baggage containing E-cigarettes.

 

D5. Electronic Devices

For safety reasons, during taxi, take-off & landing, use of personal electronic devices like mobile, camera, laptop & other entertainment gadgets (but not limited to), is prohibited. PEDs like laptop, electronic entertainment devices can be used during cruise phase only without disturbing the good order on-board.

 

D6. Photography

No passenger shall take, or cause or permit to be taken, at a Government aerodrome or from an aircraft in flight, any photograph except in accordance with & subject to the terms & conditions of a permission in writing granted by the Director-General, a Joint Director General, a Deputy Director-General or the Director of Regulations & Information of the Civil Aviation Department.

 

D7. Tampering with Safety Equipment

Passengers shall not indulge in any act (attempted or otherwise) of removal or tampering with any safety equipment (including opening of first aid kit without prior permission from the crew) on Air Taxi aircraft.

 

D8. Seating

Air Taxi reserves the right to change the seating of a passenger in order to comply with the safety regulations or for aircraft load adjustment/configuration.

 

D9. Hygiene

Even if not required by regulations, good practice in regards to personal hygiene & surrounding is a must, as it helps to ensure your crew & fellow passengers remain in good health & atmosphere. Passengers are advised to not litter on-board. Air Taxi aircrafts do not have provision of lavatory, galley compartment, sink/wash basin, food/beverage station on-board.

 

E. FARES, TAXES, FEES & CHARGES

E1. Fare Components

All fares are in Indian Rupees (INR).

Fare component includes:

  1. Base Fare
  2. Taxes, Fees & Charges.

Base Fare: It is the basic price of a ticket excluding the Taxes, Fees & Charges. It varies from sector to sector, day to day & time to time. Updated & applicable base fare can be best known while making a new booking or contacting our customer care.

Taxes & Fees: It is an amount imposed by government & airport authority on air travellers, above & over the base fare. It is subject to change at the discretion of government & airport authority while taking into account inflation, currency fluctuation, etc.

Once a ticket is purchased, the fares will not change (base fare) for that booking, except in case if the passenger requests for a change in the ticket, rescheduling charges may be applicable.

If there is any change to the existing taxes & fees or if a new rate is imposed by the government/airport authorities, after the date of issuance of ticket, Air Taxi reserves the right to collect the same from the passenger before boarding. However, if the revised amount is lesser than the amount originally paid, the difference shall be refunded back to the passenger.

 

E2. Modes of Payment

While booking a ticket with Air Taxi, following modes of payment can be used:

  1. Cash
  2. Credit Card/Debit Card
  3. Net banking
  4. UPI.

 

E3. Modification of Booking

In case a passenger, wants to modify date/flight of an existing booking, rescheduling charge (as mentioned in the charges table above) + fare difference (if any) will be applicable. Modification can be done after the booking & at-least till 2 hrs before scheduled departure time.

Air Taxi provides a “Look-in option” for a period of 24 hours after booking ticket. During this period passenger can modify the ticket without any additional charges, except for the normal prevailing fare for the revised flight for which the ticket is sought to be amended. This facility is not available for a flight whose departure is less than 7 days from booking date.

Passenger must ensure that the name entered at the time of booking, matches with the ID proof carried along on the day of travel. Air Taxi does not permit name change due to security reasons.

 

E4. Cancellation of Booking

Cancellation: It is cancellation of a booking by a passenger at-least till 2 hrs before the scheduled departure time.

Example:

Booking Date & Time: 01 Jan, 2021 @12:00 IST.

Scheduled Departure Date & Time: 20 Jan, 2021 @16:00 IST

For this booking, cancellation period is anytime after the booking i.e. ‘01 Jan, 2021 - 12:00 IST’ till ‘20 Jan, 2021 - 13:59:59 IST’. Any cancellation after ‘20 Jan, 2021 - 13:59:59 IST’ will not be counted as cancellation, but as “No Show”.

Cancellation charge will be applicable per passenger, per sector [Cancellation charge is not more than the base fare plus fuel surcharge (if applicable)].

Air Taxi provides “Look-in option” for a period of 24 hours after booking ticket. During this period passenger can cancel the ticket without any additional charges. This facility shall not be available for a flight whose departure is less than 7 days from booking date.

 

E5. Refund

All refunds will be refunded in the same mode of payment in which the payment was originally received.

Refund Timeline: Refund will be processed as per the below timeline i.a.w. the mode of payment:

  1. Cash - Immediate
  2. Credit Card/Debit Card/Net Banking/UPI - Within 7 days
  3. Booking through Agent/OTA - Within 30 days.

No Show Refund: Booking cancellation by a passenger within 2 hours of the scheduled departure time or failing to report 30 minutes prior to the scheduled departure time, will be considered as ‘No show’.

No Show Refund will include taxes & fees only.

Gate No Show Refund: Failure to show up at the boarding gate 15 minutes prior to the scheduled departure of the flight would result in the passenger being declared as ’Gate No Show’.

Gate No Show Refund will include taxes & fees only.

Refund due to Reduction of Govt Tax/fees: If there is any change to the existing taxes & fees or if a new rate is imposed by the government/airport authorities, after the date of issuance of the ticket, & if the revised amount is lesser than the amount originally paid, the difference shall be refunded back to the passenger.

Delay (of more than 2 hr): In case of a delay of more than 2 hours, passenger has the choice to either go for a refund or rescheduling of the flight (same sector, same passenger).

If the passenger chooses refund, complete fare will be refunded in the same mode of payment in which the payment was originally received, as per the refund timeline mentioned above.

If the passenger chooses rescheduling, he/she will be re-accommodated on another flight, on the same sector subject to the availability, at no additional fare.

No refund: No Refund is when the total amount is forfeited for a confirmed booking. There is no refund in the following cases:

  1. Self-offloading
  2. Denied boarding due to misconduct
  3. Cancellation of extra baggage
  4. Any ticket which has exceeded maximum validity of 1 year from the date of booking.

 

E6. Online Payment

Online payment system is provided by Aviation Connectivity & Infrastructure Developers Pvt. Ltd. hereafter referred as ACIDPL. ACIDPL may update these terms from time to time and any changes will be effective immediately on being set out here. Please ensure you are aware of the current terms. The country of domicile for ACIDPL is India.

Please read these terms carefully before using the online payment facility. Using the online payment facility on this website indicates that you accept these terms. If you do not accept these terms do not use this facility.

All payments are subject to the following conditions:

The description of services of match making are specific to your need, when you log in with your unique password. Normally payment is required in advance (i.e. before you commence your activity).

All Fees quoted are in INR (Indian Rupees). ACIDPL reserves the right to change the fees at any time.

  1. Your payment will normally reach the ACIDPL account to which you are making a payment within two working days.

  2. We cannot accept liability for a payment not reaching the correct ACIDPL account due to you quoting an incorrect account number or incorrect personal details. Neither can we accept liability if payment is refused or declined by the credit/debit card supplier for any reason.

  3. If the card supplier declines payment, ACIDPL is under no obligation to bring this fact to your attention. You should check with your bank/credit/debit card supplier that payment has been deducted from your account.

  4. In no event will ACIDPL be liable for any damages whatsoever arising out of the use, inability to use, or the results of use of this site, any websites linked to this site, or the materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages.

Refund Policy for online payment:

  1. If the Customer leaves ACIDPL before they complete their service period, there shall be no entitlement to a refund of paid service fees.

  2. Refunds, if applicable, at the discretion of the Management, will only be made to the debit/credit card used for the original transaction. For the avoidance of doubt nothing in this Policy shall require ACIDPL to refund the Fees (or part thereof) unless such Fees (or part thereof) have previously been paid.

 

F. LIABILITY FOR DAMAGE

F1. Death/Injury to Passenger

In the event of death or any other bodily injury suffered by a passenger during the course of carriage by air, Air Taxi’s liability will be governed by the relevant provisions of the Carriage by Air Act, 1972 or any modifications etc. as notified by the Ministry of Civil Aviation, Government of India, & as amended from time to time & the rules contained there under.

Notwithstanding the provisions above, if Air Taxi proves that the damage was caused by, or contributed to by, the negligence of the injured or deceased passenger, Air Taxi may be exonerated wholly or partly from its liability.

Air Taxi is not responsible for any illness, injury or disability, including death, attributable to the passenger’s physical condition or for the aggravation of such condition.

Air Taxi does not assume, & expressly disclaims, any liability to any passenger, person(s) or entities for any direct or indirect loss or damage, injury, disease, poor health or death caused to any such passenger or person(s) on account of any disease, epidemic or pandemic or contracting any such disease, on board an Air Taxi flight or in the course of any of the operations of embarking or disembarking or otherwise in the course of their journey with Air Taxi.

 

F2. Lost/Damaged Baggage

Passengers are solely responsible for carriage of their cabin (hand) baggage/personal belongings & Air Taxi will not be liable for any loss/damage of their cabin (hand) baggage/personal belongings.

Passenger shall be responsible for any damage caused by the passenger’s baggage to other persons or property, including Air Taxi’s property & Air Taxi will not be liable to any third person for any damage caused by the passenger’s baggage.

Air Taxi will not be liable for any damage arising from Air Taxi’s compliance with applicable laws or Government rules & regulations or from the passenger’s failure to comply with the same.

 

F3. Delay

Air Taxi’s liability for damage caused by delay, in the carriage/baggage is limited under the provisions of Carriage by Air Act, 1972 & the rules framed there under with certain exceptions, adaptations, modifications etc. as notified by the Ministry of Civil Aviation, Government of India, & as amended from time to time.

 

F4. Time Limitation on Claims & Action

Any right to damages shall be extinguished if an action is not brought against Air Taxi within 3 years of the date of arrival at the destination, or the date on which the aircraft was scheduled to arrive, or the date on which the carriage stopped. The method of calculating the period of limitation shall be determined under the laws & by the court of competent jurisdiction as specified in ‘Governing Laws/Dispute Settlement’ section.

 

 

G. OTHER INFORMATION

G1. Passenger Rights

If a passenger is denied boarding on an Air Taxi flight or if an Air Taxi flight is delayed/cancelled, passenger may ask Air Taxi staff at the airport to provide a written statement of rights, particularly with regards to compensation & assistance.

 

G2. Passenger Responsible for Fines/Penalty/Costs

If Air Taxi is required to pay any fine/penalty/costs because of the passenger’s failure to comply with the required law & order by the Government or due to unavailability of necessary travel documents then, the passenger is liable to bear the whole cost. The passenger in such case shall on demand, reimburse to Air Taxi for the fine borne due to the passenger’s negligence. For such re-imbursement, Air Taxi may also apply the value of any unutilised booking, or any of the passenger’s funds in Air Taxi’s possession.

 

G3. Extra Ordinary Circumstances

Air Taxi would not be liable to pay any compensation in respect of cancellations/delays clearly attributable to causes that are beyond the control of the airline. The following is a list (illustrative, not exhaustive) of circumstances beyond the control of airline:

Weather, acts of nature,  Air Traffic Control (ATC), bird strike, technical/mechanical failures, shortages of critical manpower, parts or materials, operating crew unable to reach due to congestion on roads, acts of terrorism, bandhs/strikes, riots, national security risks, governmental regulations or requirements, security congestion at airport terminals, delays in departure due to offloading/Gate No Shows, consequential delay due to late arrival of the incoming aircraft due to congestion, force majeure etc.

 

G4. Security Requirements

The passenger is required to submit to any security check at any point of time during travel. If required, the passenger shall have to undergo physical check/computerised scanning of the contents of the possessed baggage/himself by airport security/customs/other government officials/Air Taxi staff. The passenger shall be solely responsible for complying with all governmental regulatory requirements at the origin & the destination station, with these Terms & Conditions & Air Taxi staff instructions. Air Taxi advices all passengers to compulsorily retain the boarding pass in their possession until exiting the arrival terminal for security reasons.

Air Taxi reserves the right to refuse carriage of any passenger who has not complied with the above mentioned requirements.

Air Taxi shall not be responsible if passenger faces any consequences due to unavailability of required documents for complying with any regulatory requirements.

Air Taxi is not liable to any loss/damage passenger encounters during the security check or any inconvenience faced due to its non-compliance.

 

G5. Governing Laws/Dispute Settlement

Air Taxi Terms & Conditions shall be construed by, & governed in accordance with the laws of India.

The Courts of Delhi, India shall have exclusive & sole jurisdiction to settle any dispute or claim/differences arising out of, or in connection with these Terms & Conditions.

 

G6. Amendments

Air Taxi reserves the right to amend the Terms & Conditions of Carriage, at any time, without any prior notice or liability.
